Description

Francis Hopkinson Signed Deposition. One page, 7 3/4 x 12 5/8 inches, Philadelphia, Pennsylvania; August 21, 1781. A manuscript deposition regarding the capture of the brigantine Active, signed by Francis Hopkinson. Hopkinson served as judge of the Admiralty Court of Pennsylvania from 1779 to 1789, until his appointment by George Washington to the position of first judge of the United States District Court for the District of Pennsylvania.

Document reads, in part: "George Augustus Delanoe a Britney sworn and examined on the part and Behalf of the libellants in the above case deposeth and saith that he had the command of the Brig Active and on the Seventh Day of August with the said Brig active under his command as afore'd left the Island of Antigua bound with Dispatcher to the port of New York, that on the Eighteenth Day of August Instant the said Brigantine was on the high seas on her voyage aforesaid captured and taken by the ship called the Royal Louis commanded by Stephen Decatur Esquire and that of the time of such Capture the said Vessel was the property of the King of Great Britain..."

George Augustus Delanoe (1762-1802), the witness named in this deposition, was a British naval officer and Commander of the HMS Repulse. He sailed for the British Navy until the Mutiny at the Nore in 1797, during which he lost a leg in combat with an enemy ship. He survived this injury, but never sailed again, passing away five years later in Lynsted, Kent.

Condition: Moderate toning and foxing throughout. Smoothed folds, with some separation thereat.
