Description

Phillip Freneau's National Gazette: Supreme Court Decision in the Case of Chisolm vs Georgia. (Philadelphia, PA) dated Feb 27, 1793. This is the volume II # 35 issue of this newspaper that was founded and supported by Thomas Jefferson's Democratic-Republican Party and is considered the rival to the Federalist party supported Gazette of the US. This newspaper contains a back page news report of the landmark US Supreme Court decision in the case of Chisolm vs Georgia.

Chisholm v. Georgia (1793) is considered the first United States Supreme Court case of significance and impact.

Since the case was argued prior to the formal pronouncement of judicial review by Marbury v. Madison (1803), there was little available legal precedent (particularly in U.S. law). The Court in a 4-1 decision ruled in favor of Alexander Chisholm, executor of an estate of a citizen of South Carolina, holding that Article III, Section 2 grants federal courts jurisdiction in cases between a state and a citizen of another state wherein the state is the defendant.

This issue also contains a long inside page letter addressed to "Alexander Hamilton, Secretary of the Treasury of the US" and signed in type "Decius". The letter is critical of the Federalist Party in general and Alexander Hamilton in particular.

Condition: Fine.
