The McCullough vs Maryland case, decided in 1819, is a landmark Supreme Court case that established the principle of implied powers and affirmed federal supremacy over state laws. The case arose from Maryland's attempt to tax the Second Bank of the United States, a national bank chartered by Congress. The Court, under Chief Justice John Marshall, ruled that the federal government had the power to establish a national bank under the "necessary and proper" clause of the Constitution, and that states could not tax a federal entity.
