Manuscript Fair Copy of Papal Brief Issued by Sixtus V Excommunicating Henry IV of France. One page with blank integral, 8" x 11", circa 1588. Brief issued by Sixtus V during the War of the Three Henries excommunicating Henry IV: "Since it is manifest, public, and notorious and is fully and legitimately known to us that Henry of Bourbon, supposed king of Navarre and prince of Béarn, has been and is guilty of the notorious and inexcusable crime of heresy and relapsed into heresy and a promoter of heretics, therefore by the authority of Almighty God and of the blessed apostles Peter and Paul and by our authority we pronounce and declare that the said Henry of Bourbon, supposed king of Navarre and prince of Béarn, both has been and is a heretic and relapsed into heresy and impenitent, a leader, promoter, and defender of heretics, manifest, public, and notorious, such that he cannot be defended by any evasion or excuse at all... " The brief nullifies Henry's right to govern as king and directs that a papal bull be drawn up.

Together with a similar brief issued for the excommunication of Henry of Bourbon, prince of Condé, Henry's cousin.

Condition: Both documents are toned, with scattered foxing. Light soiling at edges, and untrimmed. Annotations in pencil on versos. Full translations of both documents are included.

Since it is manifest, public, and notorious and is fully and legitimately known to us that Henry of Bourbon, supposed king of Navarre and prince of Béarn, has been and is guilty of the notorious and inexcusable crime of heresy and relapsed into heresy and a promoter of heretics, therefore by the authority of Almighty God and of the blessed apostles Peter and Paul and by our authority we pronounce and declare that the said Henry of Bourbon, supposed king of Navarre and prince of Béarn, both has been and is a heretic and relapsed into heresy and impenitent, a leader, promoter, and defender of heretics, manifest, public, and notorious, such that he cannot be defended by any evasion or excuse at all, and has thus damnably become liable to the penalties, censures, and punishments contained in the sacred canons and constitutions and the general and particular laws and due to relapsed and impenitent heretics; and especially that he has been and is deprived by the law itself of the alleged kingdom of Navarre or of the part of it that he has held up to now, of the principality of Béarn, and of all other lordships, states, cities, lands, towns, and feudal estates, possessions of any kind, and successions, honors, dignities, also kingdoms, and offices, rights, and jurisdictions that he holds de facto and has had a right to in any way whatsoever; and that he has thereby rendered himself unqualified and incapable and has been and is unqualified to hold and incapable of holding the same kingdom, the principality of Béarn, and the other aforesaid lordships, states, cities, lands, towns, and feudal estates and possessions of any kind, successions, dignities, honors, offices, rights, and jurisdictions to be obtained or retained in the future, as well as incapable of succeeding to any principalities, duchies, lordships, states, and kingdoms whatsoever, and especially to the kingdom of France and any states and lordships attached to it, as we deprive the same Henry, alleged king, to the extent necessary, of the kingdom of Navarre or part of it and of the aforesaid principality, lordships, and other holdings and perpetually disqualify him from them and from the succession to any principalities, duchies, lordships, states, and kingdoms whatsoever and to the said kingdom of France and its attached states and lordships, in this way and in all better ways, rights, and forms in which we are able and ought to do so, and otherwise, in accordance with the document to be drawn up on this matter under the leaden seal. In the name of the Father and of the Son and of the Holy Spirit. Amen.
