    The Tombstone and Arizona Territory Collection

    Graham County, Arizona: Rare Order for Execution of Native American. A rare handwritten warrant of execution, 7.75" x 18.5", dated May 17, 1890, for El Chers Choose or Choas for the "crime of murder" and written and signed by Richard E. Sloan, judge in the court of the First Judicial District, Graham County, Arizona Territory, and co-signed by Frank Dysart, clerk. The front side of the document bears the stamp of the First Judicial District Court. On the back of the document is a handwritten and signed statement by Graham County Sheriff William Whelan, dated July 11, 1890, certifying that he received the warrant of execution on May 17, 1890, and that "in compliance with the within command the said El Chers Choas was on the 11th day of July 1890 between the hours of 2 and 3 PM executed by hanging by the neck until he was dead, said execution taking place in the jail yard of the County jail and was conducted in conformity to the provisions of law of this Territory and of the sentence referred to in said document." William "Billy" Whelan, a legendary Arizona lawman, served as sheriff of Graham County in 1889 and 1890. Judge Richard Elihu Sloan (1857-1933), was a U.S. District Court Judge and the seventeenth and final territorial governor of Arizona. This is a rare document that provides a sense of the practice of law in Arizona Territory during the late nineteenth century. The warrant has five horizontal folds that exhibit various levels of weakness, with the top two attached by tape. All the folds are supported by tape. The document is in fair to good condition.
