    The Tombstone and Arizona Territory Collection

    Graham County, Arizona: Petition for Writ of Habeas Corpus. Two documents relating to a petition for habeas corpus for P. Finn Clanton of the notorious Clanton Gang. 1) A handwritten petition, on an 8" x 24.5"sheet, folded in half, dated August 29, 1890, in which Clanton asks John Blake, District Court Commissioner for Graham County, Arizona Territory, for a writ of habeas corpus because he claimed that he was imprisoned illegally by William Whelan, sheriff of Graham County, "upon the charge of branding calves, unlawfully and with felonious intent." The document also includes Clanton's sworn affidavit that he is the petitioner for the writ. Clanton signature appears after both sections and is also signed for Frank Dysart, clerk of the district court by Edward Tuttle, deputy clerk. This section bears the seal of the First Judicial District Court. The reverse of the document is bears the signature of Frank J. Henry Clanton's attorney. 2) An official district court order granting writ of habeas corpus to Clanton. The document, 8" x 12.5", is completed, in ink, and signed by John Blake, district court commissioner and dated August 29, 1890. The order bears the seal of the First Judicial District Court. The reverse of the document bears the signatures of Frank Dysart by Edward Tuttle and that of Clanton's attorney, Frank J. Henry. Finn Clanton was a brother of the outlaws Billy and Ike Clanton. William "Billy" Whelan, a legendary Arizona lawman, served as sheriff of Graham County in 1889 and 1890. These are exceptional documents that provide a glimpse into the legal system of early Arizona. Each document has several horizontal folds, but are overall in good condition.
