Tombstone, Arizona: Rare Handwritten Arrest Warrant to Murder by Controversial Justice of the Peace. A rare handwritten order, 8" x 12.5", addressed to the "Sheriff of the County of Pima, to arrest and hold Dan Keo" in order "to answer upon a charge of murder committed on the 30th day of June A. D. 1879 in Pima county" near the town of Charleston. The order was written and signed by James C. Burnett, Justice of the Peace in Charleston, Arizona Territory, on July 3, 1879. In 1897, Burnett was shot and killed by the O.K. Corral in Tombstone by prominent local businessman William Cornell Greene (1852-1911), who blamed Burnett for his daughter's death because Burnett has destroyed a dam on Green's property that let loose a flood that killed Green's daughter. Greene was acquitted. The arrest warrant is accompanied by a photograph, 8" x 6" albumen print on 7.25" x 9.25" mount, of the house of Sam Barrow of Tombstone. On the photograph is Barrow's mother, Mary Priscilla Blair Barrow and a maid, Mary Garvey. Barrow had loaned to Greene the gun he used to shoot Burnett and also put of part of Greene's bail after he was arrested. The warrant is in good condition, with a small piece missing from the top edge, which does not affect the text. The photograph has suffered from moisture damage and is missing half of the left hand backing and about two inches of backing at the lower left hand corner. A small part of the upper left hand side of the albumen print is missing. The middle bottom of the mount and part of the print have been affected by moisture stains. The print overall suffers from what appears to be moisture stains. Overall, the photograph is in fair condition.
