    United States vs. Yamashita Court Documents, 18 Volumes. A group of 18 bound portfolios containing the court proceedings for the trial of Japanese general Tomoyuki Yamashita accused of war crimes committed by his troops in the Philippines during World War II. The trial ran from October 29 to December 7, 1945, held before the Military Commission in Manila. The case was controversial as it determined the responsibility of commanding officers for atrocities committed by their subordinates. Yamashita denied any knowledge of the crimes his soldiers had committed, and the defense argued that even if he had known, the chaos of the situation would have prevented him from doing anything about it. Nevertheless, Yamashita was found guilty and sentenced to death. He was executed on February 23, 1946. The case set a new legal precedent, known as the Yamashita standard, which states that commanders may be held responsible for their subordinates' actions regardless of not having ordered or condoning such actions, or even not having known about or having the means to stop such actions.

    The volumes were previously held at the Library of Congress and have since been deaccessioned. Each volume is stamped in purple ink on the front free paper, "Surplus Duplicate." Each volume is tied closed with a blue ribbon. The volumes contain the following:

    The proceedings include witness testimonials and other court transcripts. The exhibit files hold photographs, diagrams, and other material submitted during the trial.

    Condition: The top pages of some volumes are darkly toned. All pages have been hole punched at the top edge. Minor creasing to some pages, else very good. The volumes and tie ribbons are worn, but remain stable.
