    Description

Civil War: Original Oil Painting of Captain Joseph Burger, Congressional Medal of Honor and Grandfather of United States Supreme Court Chief Justice Warren Burger. The painting shows Burger in a post-Civil War officer's uniform holding an 1860 staff and officer's sword. He proudly wears his original Congressional Medal of Honor and the replacement Congressional Medal of Honor introduced in 1904. Burger received the medal while serving as a 13-year-old Private in Company "H" of the 2nd Minnesota Infantry. On February 15, 1863 Burger was assigned to a Union wagon train on a road near Nolensville, Tennessee. The small detachment of sixteen men was attached by a Confederate cavalry troop of 125 men. The vastly outnumbered Union soldiers repulsed the attack and saved the train. Despite his tender years, Burger was cited for his heroism on July, 30, 1863. He was finally presented his medal on September 11, 1897.
The painting measures 25" x 30" and is attractively framed to an overall size of 30.5" x 35". The artist was C. Gregory Stapko, a portrait painter and the nation's foremost copyist of famous works of art. Stapko's work hangs in the White House, Blair House, Arlington House, U.S. Military Academy at West Point, U.S. embassies, government agencies and the Cosmos Club. He did original portraits of Supreme Court justices. The painting is signed in the lower right corner "Stapko".
The frame has a plaque on the back that is engraved "Property of W.E.B.". The painting, commissioned by Chief Justice Warren E. Burger, was a prized possession from his Supreme Court office. Sold with two modern calligraphy copies of the Joseph Burger's citation.
