    Description

The Constitution of the State of Texas, as Amended in 1861. The Constitution of The Confederate States of America. The Ordinances of the Texas Convention: and An Address to the People of Texas. Austin: John Marshall, 1861. 8vo. 80pp. Paper wrappers; disbound with stitched binding. Moderate age toning throughout, but a nice tight copy in fine condition.

Following the ratification of secession from the Union on February 23, 1861, the Texas Secession Convention reconvened. Convention delegates carefully directed the new state's transition from a Union government to a Confederate government. Toward that end, they amended the Constitution of 1845 but did not substantially change any important law. The words United States of America were replaced with Confederate States of America. Slavery and states' rights were more directly defended. A clause regarding emancipation of slaves was eliminated, and the freeing of slaves was declared illegal. All current state officials were required to take an oath of loyalty to the Confederacy, and all existing laws not in conflict with the constitutions of Texas or the Confederate States were declared valid. The conservative document was so designed to allay fears of the radical nature of the secessionists and to ease the transition of Texas into the Confederacy.
