    Texas Senator Alexander W. Terrell's Personal Copy of the 1884 Journal of the Senate of Texas and a Copy of His Controversial Grazing Regulation Speech. A. W. Terrell moved to Texas in 1852 shortly after he passed the bar in Missouri. Though an ardent Unionist he nonetheless joined the 1st Texas Cavalry as a major ultimately attaining the rank of brigadier general. He participated in the battles of Mansfield and Pleasant Hill. After the war he fled to Mexico where he briefly served as Emperor Maximilian as a battalion commander. He returned to Texas in 1866 and resumed his law practice in Houston. He served several terms in both the Texas House and Senate.

    Included in this lot is Terrell's copy of the Journal of the Senate of Texas Being the Called Session of the Eighteenth Legislature, Begun and Held at the City of Austin, January 8, 1884, Austin: E. W. Swindells, quarto, 195 pages, marbled paper over boards with a badly replaced tape spine, contents chipped and slightly brittle, else good. There are numerous holograph notes in Terrell's hand on the rear endpapers. Also included is a copy of Speech of Hon. A. W. Terrell, Delivered in the Senate of Texas, January 21, 1884, on Senate Bill No. 2, Entitled "An Act to Regulate the Grazing of Stock in Texas and to Prescribe and Provide Penalties For Its Violation." Austin: E. W. Swindells, 1884. Octavo. 24 pages, missing printed wraps, else very good. Terrell's speech argued for legislation to make it a felony to cut fences and this effectively led to the end of the open range and ergo was very controversial.
