Edgar Rice Burroughs' Signed Contract for the First Edition of The Land That Time Forgot

Edgar Rice Burroughs [1875-1950, American novelist]. Signed Contract for The First Trade Edition of The Land That Time Forgot. [Reseda and Chicago]: December 10, 1923. Signed contract. Signed at the bottom of the second page by Burroughs, Joseph E. Bray, Vice President for A. C. McClurg & Company, and two witnesses. With Burroughs' ink stamp above his signature, and Burroughs' embossed stamp (dated March 26th [?] 1923) over the signature of one of the witnesses. Two type-written folio pages on two folio sheets. Approximately 13 x 8.5 inches. On plain white paper. Some toning and edgewear to leaves, several horizontal creases, some light creasing in upper left corner, as well as paperclip markings and staple-holes, evidence of sticker removal on verso of second leaf. Also on verso of second leaf is the following ink note, in an unknown hand: "The Land that Time Forgot/Agreement with/Edgar Rice Burroughs/ Dec. 10 1923". One ink correction and one later ink note on the first leaf (in unknown hands). Overall very good. Chemised in custom full blue morocco, gilt, clamshell case.
Perhaps the most unusual aspect of this contract is that there is no mention of payment up-front to Burroughs. Burroughs was to receive a royalty of 15% on the first ten thousand sold (based on a catalogue price of $2.00 per copy) and 20% thereafter. Burroughs was also responsible for text corrections after the printed proof was made, beyond an initial $25 of printer's fees paid by the publisher. However, Burroughs reserved all movie and serial rights to this book, as well as foreign translations. Burroughs was to also receive twelve copies of this book upon publication, and a 40% discount on all copies thereafter. This contract awards exclusive publication right to A. C. McClurg during the copyright period and renewals - but one of the later ink notes (in red ink) states that these rights were cancelled and "transferred to Ed. Rice Burroughs April 11 '39 for 50.00". The San Clemente Collection of Edgar Rice Burroughs.
