    Phillips, Wendell: ARGUMENT OF WENDELL PHILLIPS, ESQ., BEFORE THE COMMITTEE ON FEDERAL RELATIONS, (OF THE MASSACHUSETTS LEGISLATURE,) IN SUPPORT OF THE PETITIONS FOR THE REMOVAL OF EDWARD GREELY LORING FROM THE OFFICE OF JUDGE OF PROBATE, February 20, 1855.     Loring was a commissioner under the Fugitive Slave Act, and hence responsible for determining the status and disposition of alleged fugitives. In addition, he was a Massachusetts probate judge. "Anthony Burns, an alleged fugitive, was arrested in Boston in June, 1854...Loring issued the certificate of removal despite conflicting testimony on whether Burns was, in fact, the same man as the fugitive in question." Cover at 179. Phillips, the well-known Massachusetts abolitionist and lawyer, and his allies "instigated a campaign to seek Loring's removal from his office of probate judge by means of 'address' by the state legislature. The Garrisonians had their forum. Edward G. Loring was on trial for having been a slave commissioner." Id.

    At the hearing, "Phillips steadfastly refused to characterize the proceeding as an attempt to remove Loring for the content of his decision. He maintained, consistent with his past work, that it is acting as commissioner that is reprehensible, not deciding in accord with the law as it appears to be on a good faith reading. To participate in the re-enslavement of a humble, hard-working man...was a morally reprehensible act. The perpetrator of this act should not sit to protect widows and orphans." Id. The legislature agreed and Loring was removed as a probate judge.
