Description
Martin Van Buren Autograph Endorsement Signed "MV Buren". Two pages of a bifolium, 7.5" x 13", Albany; December 8, 1818. In response to the included letter, Van Buren answers an inquiry regarding the damages to properties affected by the Canal from Lake Champlain to the Hudson, and how the appraisers should proceed. The Champlain Canal, finished in 1818, connects the south end of the lake to the Hudson River in New York. The canal appraisers wanted to know if they should take into consideration any benefits or advantages individuals whose property was not cut through by the canal might receive. Van Buren responded:"The language of the act is not as explicit in this respect as it might be but it appears to me that the only equitable construction of it will be to confine the consideration of benefit & damage to the immediate 'premises' through which the canal passes, to go beyond that would in many cases lead to palpable relative injustice and open a field too unlimited and undefined to hope for a correct general result, by the exercise of the limited means granted to the appraisers."
Condition: Lightly toned throughout. Flattened folds, with some separations at the folds and small tears in places. Light foxing and some soiling/residue from the wax seal. There are a few small holes on the blank third page.
