    Samuel Chase Court Document Signed. One page, 8.75" x 14", Rhode Island, June 25, 1796. Chase is here giving judgment in the libel suit of Thomas Jennings v. Brig. Perseverance, decreeing "...that the Libel be dismissed...[and] that the proceeds arising from the Sales of the said Brig Perseverance in the hands of William Peck amounting to five thousand and twenty eight dollars be by him restored and paid to Vice Consul Louis Arcambal of the French Republic, admitted by this Court as Claimant in this case..."

    This copy appears to be a draft as there are several corrections made to the text. Docketed on the verso. Moderate to heavy toning on the upper and lower edges. Folds are weakened and beginning to separate at the edges, but not affecting the text. Text remains bright. Chase's signature and paraph are very bold as is the rest of the document.

    The case was eventually appealed and sent to the Supreme Court. The Court ruled: "The decision in Wiscart v. Dauchy, (3 P. 321,) confirmed. An objection that counsel fees were allowed in the court below as part of the damages, can not be entertained unless the fact appears by the record. If a prize is sold by agreement, and the money stopped in the hands of the marshal, by a third person, not a party to the agreement, increased damages are not allowed, but only interest on the debt.."     Samuel Chase (1741-1811) represented Maryland at the Continental Congress and was a signer of the Declaration of Independence. He was appointed by George Washington as an associate justice on the Supreme Court, and was impeached for allegedly allowing his political leanings affect his court decisions. He was acquitted, and went on to serve on the court until his death in 1811.
