    John C. Hays Signed Power of Attorney Document. Four pages of a bifolium, 7.75" x 10", County of Bexar, Texas; May 17, 1847. A manuscript document granting the power of attorney to Henry M. Lewis, signed "John C. Hays". In full:

    "Know all men by these presents, that I John C. Hays of said County and State have authorized constituted and appointed Henry M. Lewis of the City of San Antonio my true and careful Attorney in Fact, for me and in my name generally to do and perform all and every act relating to business of any kind which may be necessary to be performed during my absence to the Rio Grande until I shall return to Bexar, more particularly I authorize him to do and perform all business which I have in the Land office at Austin which can be Delegated to another either in my individual capacity or as agent for others or as Surveyor to apply for and receive any and all Patents, coming to me individually or as agent for others, particularly to perform all acts necessary to obtain any such Patents.

    And I further authorize him the said Lewis to account for and with any and all persons who may be indebted to me to receive receipt and account for any and all debts due me by note account or otherwise, if necessary to due plead and be impleaded, and generally to perform in as full and entire degree as I could myself if present any and all business of whatever kind it may be which is susceptible of allegation, and I hereby ratify and confirm all acts of said Lewis my said attorney done in my behalf during my absence, declaring the same to be valid and binding with me, and I further authorize him to sign my name in buying or selling.

    In testimony of which I have herewith act my hand and affixed my seal in the City of San Antonio this ___ day of May A.D. 1847."

    John Hays had been serving as commander of the First Regiment, Texas Mounted Riflemen during the Mexican War, when he married Susan Calvert on April 29, 1847. Hays signed the power of attorney offered here approximately two weeks later to ensure that his family's interests would be cared in the event that something happened to him. Hays served through the entire Mexican War, serving valiantly and with distinction.

    Condition: Lightly toned with mail folds, partial separations at the folds. Dampstaining and soiling along vertical edges. Very fine, ink remains legible and bold.
