Sheriff Hays is summoned before a judgeJohn C. Hays Autograph Endorsement Signed Twice on verso of a signed statement by Henry Hoyt. Single sheet, 7.75" x 6.25", October 22, 1850, San Francisco. Statement reads: "Henry P. Hoyt being sworn says that John C. Hays Sheriff of the County of San Francisco has money in his hands belonging to James T. Atwood [William F. Vincent has been crossed out], that said Atwood is indebted to deponent." Hoyt signs his name attesting to the veracity of the statement.
On verso, Hays has signed to acknowledge the receipt of the letter, and adds the following signed statement: "No money in my hands belonging to James T Atwood. the monies in my hands belonging to the said Atwood was paid to Nerton Saterly [?] & [illegible] who were plaintiffs for the said Atwood / Oct. 23rd 1850 / John C. Hays / Sheriff."
Accompanied by a summons ordering Hays to appear before the judge on October 28, 1850. One page, 7.75" x 13", "State of California / County of San Francisco / Second Township"; October 22, 1850. In part:
"... a complaint has this day been made before me a Justice of the Peace for the county, by Henry P. Hoyt against James T. Atwood that the said Atwood is firstly indebted to him in the sum of two hundred dollars over and above all legal set offs, and that the said Atwood has absconded from the state with the intention of defrauding his creditors, and whereas it has been shown to me by affidavit that John C. Hays of this county has in his possession certain moneys belonging to the said James T. Atwood..."
Condition: Flattened folds, light toning at edges. Slight chipping at some edges, otherwise very good.
